How to Issue a Power of Attorney in the United States for Use in Palestine

A power of attorney prepared in the United States should be designed for the specific transaction and the Palestinian authority that will receive it. Notarization alone should not be treated as confirmation that the document will be accepted.

1. Confirm the purpose before signing

Start by identifying the task: obtaining records, handling an inheritance file, conducting litigation, or completing a property transaction. Ask the receiving lawyer, court, registry, or other authority to review the proposed wording before you arrange signatures or authentication.

The document should clearly identify the principal and representative. For property matters, check names against the title records and identify the relevant parcel and ownership share. Discuss whether the authority includes signing contracts, transferring ownership, receiving money, appointing another representative, or settling a dispute. These powers should not be added casually.

2. Check the U.S. execution and authentication route

Confirm the requirements of the U.S. state where the document will be signed and the requirements of its destination. USA.gov explains that the destination determines whether an apostille or authentication certificate is appropriate. Do not assume an apostille completes every requirement for use in Palestine.

Where the authentication-certificate route applies, the U.S. Department of State provides preparation instructions, including the relevant state certification stage for state documents. Authentication confirms official signatures and seals; it does not validate the document’s legal content. Confirm any further legalization or local acceptance requirements with the receiving authority before sending originals.

3. Arrange language and document handling

  • Confirm whether Arabic wording or a certified translation is required.
  • Check that names, identity details, dates, and property references are consistent throughout.
  • Ask whether original documents are required and how they should be delivered.
  • Keep copies of the signed document and attached certifications.
  • Confirm acceptance of remote notarization before relying on it.

Before authorizing a representative

Discuss the scope, duration, reporting arrangements, and any restrictions on the representative’s actions. A document suitable for collecting records may be unsuitable for selling property. Issuing a power of attorney also does not guarantee that every stage can be completed without personal attendance.
